Carriers Can Now Dispute Out-of-Service Declarations and Notice & Orders
On September 9, 2013, the Commercial Vehicle Safety and Enforcement branch (CVSE) implemented a new Dispute Resolution Process for Out-of-Service declarations and Notice & Orders.
The Dispute Resolution Process, which is not retroactive, allows carriers to request reconsideration of these two specific types of enforcement from September 9 onward, in situations where there is evidence that an enforcement decision was mistaken or unfair. Carriers are being encouraged to ask for review upon receiving notice of the OOS declaration or N&O, and the CVSE expects to solve most disputes almost immediately. The review process, which CVSE arrived at with input from the industry, will involve consideration of the dispute at different levels of authority until the dispute is either resolved or rejected.
The Dispute Resolution Process does not include violation tickets, vehicle impoundments or allegations of officer misconduct, for which there is already a review process in place.
